This website is owned and operated by ‘The Bamboo Manager Project’. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This site offers visitors the option to register an account with ‘The Bamboo Manager Project’ & purchase products as described on the site platform.

These products include but are not limited to: -

Online* educational courses from those listed within the site

Direct one to one tuition of a course to be carried out in person.

Engage in a contract to receive services as stated on the site

(services are subject to the attached specific terms and conditions to each product offered).

To purchase from the promotional merchandise retail section of the site.  

‘The Bamboo Manager Project’ reserves the right to remove services that it offers without prior notice.

By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

*Please note the services of a third-party platform ‘instructure.com’ will be utilized to run the online courses and therefore will be subject to the third parties own Terms & Conditions (Acceptable Use Policy)

Who can use our website; what are the requirements to create an account

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. If below the stated age you may engage the services provided it is with the involvement of a parent or legal guardian.  You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

To access any of our services (apart from promotional offering) you must become a member of the site, "thebamboomanagerproject.org".

It is your responsibility to maintain the confidentiality of your account and passwords and the restriction of access to your account. You accept that you will be held responsible for any activities that are carried out within your account and that ‘The Bamboo Manager Project’ reserves the right to terminate accounts and refuse the provision of services should they feel it to be necessary.

Key commercial Terms offered to customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing (including our Return, Refund and Cancellation of services Policy) before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website or will be conveyed to you via email if relating to either a Bespoke package, Conference, International Teaching etc. where a
member of ‘The Bamboo Manager Project’ in person or via a digital platform is required to attend.

We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page or on request.

All transaction fees will be charged at the time of purchase. Goods and services will be shipped within 7 days or less unless you are notified otherwise either by email or as stated on the product page.

“The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Return and refund policy

We at The Bamboo Manager Project understand that a simple ‘click’ maybe a simple mistake or your circumstances may have changed. We offer the required 14 day returns policy on our online products, sometimes known as ‘the cooling off period’.

Below we outline our policy to the various products offered and any related administration fee that may be implemented.

 

Online courses

Online courses and products related to these courses are exempt from the 14 day returns requirement once the course and its materials have been accessed.

After the course is accessed No Refunds will be entered into.

We deem that the course has been accessed when the course is activated by entering and logging into the third-party hosting site of the course ‘instructure.com’,by  using your unique personal ID (which will have been supplied by us via email following your purchase).

 

If you have changed your mind or believe that the course you ordered is not the one for you at this time

Please include all of your account details within the email

 

We will check that there has been no access or activity within your course account prior to entering into the refund procedure.

Please note that all of our courses are taught in English at this time.

Cancellation of services Policy

​

Educator/International Learning, Conference Speaker & Bespoke Services

Cancellations made by you for any services previously booked, which requires a member of ‘The Bamboo Manager Project’ in person or via a digital platform to attend i.e. training - speaking - educational event.

 

Cancellation made 28 days prior to the scheduled event will incur no administration fee, however any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

 

Cancellation 15-27 days prior to the scheduled event will incur a 20% administration fee of your original payment and any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

 

Cancellation 8-14 days prior to the scheduled event will incur a 50% administration fee of your original payment and any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

Cancellation 0-7 days prior to the scheduled event, no refunds will be issued. Any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. will be invoiced for.

Consultancy

Cancellations made by you for any services previously booked, which requires a member of ‘The Bamboo Manager Project’ in person or via a digital platform to attend a consultancy event.

​

Cancellation made 28 days prior to the scheduled consultancy will incur no administration fee, however any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

 

Cancellation 15-27 days prior to the scheduled consultancy will incur a 20% administration fee of your original payment and any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

 

Cancellation 8-14 days prior to the scheduled consultancy will incur a 50% administration fee of your original payment and any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be subtracted from the refund due to you and any outstanding balance shall be invoiced for.

Cancellation 0-7 days prior to the scheduled consultancy, no refunds will be issued. Any costs that we have made in direct response to your original booking i.e. travel, visas, accommodation etc. these will be invoiced for.

Promotional merchandise product

For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method.

 

When we receive, a valid warranty claim for a merchandise product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to the customer and the customer will be responsible for the return shipment of the product to us.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Warranties & responsibility for services and products

All opinions, views, recommendations & content expressed within our Site are those held by ‘The Bamboo Manager Project’ and are offered as an option to achieve the fulfilment of the knowledge being sort by the purchaser. Any opinions, views, recommendations & content expressed on a third-party site are not necessarily those of ‘The Bamboo Manager Project’.

‘The Bamboo Manager Project’ will not be held liable for any failure by any third parties to supply the course content for any reason outside of our control.

Limitations of use

The Information which is expressed within our courses may be limited and not limited to the following examples:

 

(i) That the course will NOT offer every scenario and answer to events or situations that may arise in your future within the Entertainment Industry, Education or Business sectors.

 

(ii)The information given within the courses is, to the best of our knowledge correct at the time of creation. It is your responsibility to ensure that such information is correct in relation to your country or under any law or regulation applicable to your locality before implementing them.

 

(iii)That these are the only methods to achieve that of industry practices or that of the desired knowledge base.

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property ‘The Bamboo Manager Project’. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.


You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website or third party hosts, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on ‘The Bamboo Manager Project’ website.

 

 

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination, you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold ‘The Bamboo Manager Project’ & its associates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

 

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall ‘The Bamboo Manager Project’ & its associates, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, ‘The Bamboo Manager Project’ & its associates assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

 

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

 

 

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United Kingdom without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located In- Cardiff, Wales. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
